Rape case dismissed against Huber Heights Doctor

DAYTON, Ohio (WDTN) –  A doctor accused of rape is free Monday after the case was dismissed just as the trial against him was to begin.

The woman who accused Dr. Robert Hunter of an assault in Taylorsville MetoPark in 2015 testified in court Monday that she asked the Prosecutor’s Office to dismiss the charges.

Hunter, a doctor in Huber Heights, was indicted on four counts of rape and one count each of kidnapping and abduction in December. Hunter was arrested at his medical practice in Huber Heights by Five Rivers MetroParks Police after an investigation into an assault was reported to have happened inside a care at Taylorsville MetroPark in July 2015.READ MORE:Huber Heights doctor indicted on rape charges

Monday in court, the woman who filed the charges against Hunter testified that she had been unhappy with the handling of the case by the Montgomery County Prosecutor’s Office and wanted the case dismissed. Under oath and being questioned by the prosecution, the accuser answered yes or no to several questions but gave no detailed answers. When asked if she wanted the charges against Hunter dismissed she answered only, “Yes.”

Prosecutors made it clear they were prepared to move forward with the case and asked the accuser if she still wanted the case dismissed even though prosecutors wanted to continue and she answered, “Yes.”

Judge Dennis Adkins granted the dismissal of the case and commented from the bench that the court was “disturbed” by the handling of this case but did not elaborate. The case was ordered dismissed without prejudice by Judge Adkins.
