Police called to gas station after man reportedly uses heroin

DAYTON, Ohio (WDTN) — A man was arrested after he’s accused of running from a police officer after he reportedly used heroin inside a gas station bathroom.

Police were flagged down Friday before 5 p.m. by someone at the Shell gas station located at 1415 South Smithville Road. A person reported a man spent 25 minutes in the restroom and would not open the door. There was a concern that he potentially overdosed on heroin.

When officers entered the gas station, they found the man at the condiment station in the store and reported he appeared to be under the influence of heroin. Police said when they began to pat him down, he took a swing at an officer, hit him, pushed him, and ran out of the store towards the parking lot.

Officers chased him and then tased him after he reportedly refused to stop.

Brian Miser, 30, was taken into custody=.

Police said he was carrying four capped syringes, a pipe to smoke crack cocaine, and a car stereo in his bag.

Miser was taken to the hospital for treatment before being booked into the Montgomery County Jail. He faces charges of disorderly conduct, obstructing official business, resisting arrest, possessing drug abuse instruments, and advertising and possession.
