Ohio man who says left injured in towed car files lawsuit


DAYTON, Ohio (AP) — A man who says he went undetected in a crashed vehicle for hours after it was towed from a 2015 accident scene is suing an Ohio sheriff’s office employees and the towing company.

Court records show Mark Gilliam is suing the Montgomery County sheriff, a deputy and Busy Bee Auto Parts & Towing in federal court in Dayton. The lawsuit charges gross negligence and recklessness among other counts.

The lawsuit seeking more than $25,000 says a towing employee found Gilliam injured and screaming for help inside his car about six hours after it was towed. The lawsuit lists injuries including fractured ribs.

The company’s attorney declined to comment Wednesday. The attorney representing sheriff’s officials didn’t immediately return calls.

Authorities had said Gilliam crashed his car early New Year’s Day 2015.
