KETTERING, Ohio (WDTN) – A Kettering teen convicted in the 2016 fatal shooting of a Fairmont High School student will be re-tried in May.
Kylen Gregory will face felonious assault charges in the murder of Ronnie Bowers.
A jury in November found Gregory guilty on two counts of reckless homicide and deadlocked on the felonious assault charges.
Because Gregory was convicted on charges that did not require mandatory transfers to adult court, the case will be considered in juvenile court, where Gregory could face a lighter sentence.
If the court believes that Gregory would be amenable to treatment in the juvenile system, his adult court case will be dismissed.
On the other hand, if it is determined that he would not be amenable to treatment in the juvenile system, then final sentencing will be imposed from the adult court.
