Ohio AG’s office files consumer protection lawsuit against Dayton business

DAYTON, Ohio (WDTN) — The Ohio Attorney General’s Office has filed a consumer protection lawsuit against a Dayton business.

Attorney General Mike DeWine’s office announced the lawsuit against a heating and air-conditioning provider accused of repeatedly failing to deliver promised services to people in southwest Ohio.

The lawsuit accuses Daniel W. Wells of taking money for services he never provided or performing shoddy work while operating under the names Kelly Heating & Air Conditioning, Reagan Same Day Heating & Cooling, and Kelly’s Plumbing & Heating. 

“We’re taking this action to protect consumers,” Attorney General DeWine said. “We think people should know about the repeated problems customers have had with this operator.”

In 2017, the Ohio Attorney General’s Office obtained a judgment against Wells in a similar consumer protection case. A further investigation by the AG’s office found that the problems continued. 

The new lawsuit concerns 18 complaints filed against Wells’ companies in the past two years. In their complaints, consumers generally said they paid hundreds of dollars or more for furnace or air conditioning services they never received.

They also said the company would not return to correct problems or complete the work.

The Attorney General’s lawsuit, filed in the Montgomery County Common Pleas Court, accuses Wells of violating Ohio’s Consumer Sales Practices Act and Home Solicitation Sales Act. The lawsuit seeks a permanent injunction to ban Wells from doing business with new consumers until he repays the other consumers he owes.
