DAYTON, Ohio (WDTN) – Justin Smith’s hearing scheduled for Wednesday at Common Pleas Court in Montgomery County has been rescheduled.

Smith, who is an inmate at the Correctional Reception Center in Orient, was filing a Motion to Suppress. The motion is made by defendants wanting certain evidence removed from trial. Smith’s hearing is rescheduled for Feb. 26. His trial on 41 counts relating to flight from jurisdiction is scheduled for May 13. He pled not guilty to the charges at his arraignment in January.

Smith was a youth soccer coach in Germantown. He was on trial for three counts of sexual battery for an inappropriate sexual relationship with a 14-year-old girl when he cut his ankle tracking bracelet and left the area. He was on the run for two months before being arrested in Florida.
