MIAMI TWP., Ohio (WDTN) - A fired Miami Township police officer is taking his first step toward returning to his job.
Major John DiPietro filed appeal papers Tuesday in Montgomery County Common Pleas Court.
The Miami Township Board of Trustees fired him February 13, 2013 after a report concluded that he acted improperly with a shoplifting suspect.
DiPietro was alone with a naked, teenaged girl while he decontaminated her after she was sprayed with pepper spray during her arrest.
Dipietro is now claiming he did not get a fair hearing because a member of the board was biased against him and that no evidence was presented that he violated the rules.
A hearing date must now be set.
