MIAMI TWP., Ohio (WDTN) - A court ruling released Friday finds the rights of a fired Miami Township police officer were violated.
John DiPietro lost his job back in February.
The Board of Trustees determined he acted inappropriately when he hosed down a 17-year old shoplifting suspect who was pepper sprayed during her arrest for shoplifting.
The court determined upon appeal that the board did not have the authority to fire DiPietro because they were not the ones who filed the charges as required by Ohio code.
The court will not decide whether DiPietro deserves his job back yet.
It will hold a hearing on missing evidence from his disciplinary hearing next month.
The township settled the case with the teenager involved and her family for $100,000.
