DAYTON, Ohio (WDTN) - The contest for a seat on the Montgomery County Commission has been decided.

Incumbent County Commissioner President Dan Foley beat out challenger Jan Kelly in a race that was at first count too close to call.

The Montgomery County Board of Elections certified the results in meeting Nov. 23.

Out of 181,151 votes cast, Foley won 92,201 to Kelly's 88,950.

Election officials said the margin of falls outside the realm of an automatic recount, and if she would want a recount, Kelly would have to bear the cost.
