Ginseng death prompts change of plea

PREBLE CO., Ohio (WDTN) - A Preble County businessman pleaded guilty to a lesser charge in a Preble County shooting case.

Joseph Kutter , 79, pleaded guilty Tuesday to a reduced charge of voluntary manslaughter for the death of Bobby Joe Grubbs , 31.

Grubbs' body was found on Kutter's property in June 2012.  He was buried under a dump pile.

Kutter said he shot Grubbs to protect himself and his property.  Grubbs was looking for ginseng at the time he was shot.  Kutter says he was stealing it from his property.

Kutter was indicted on a murder charge in July 2012.  A jury found him guilty of tampering with evidence and gross abuse of a corpse, but it could not reach a verdict on the murder charge.

He will be sentenced on the new charge June 11.
