Wayne teacher appears in court on sex charges

HUBER HEIGHTS, Ohio (WDTN) - The Wayne High School teacher facing sexual battery charges was silent as she appeared in court with her attorney Tuesday.

A judge arraigned Kelsey Hartmann on three counts of sexual battery involving a minor during the brief hearing.

Hartmann and her attorney declined to comment as they left the court room. The case now will be presented before a Montgomery County grand jury. If indicted, Hartmann will face a trial.

Hartmann, a Spanish teacher, was arrested and charged Wednesday after the alleged incident involving a student. Police records indicate the investigation began Nov. 19 near the Canal Locks. 

According to police records, an officer spotted an SUV with fogged-over windows and discovered Hartmann performing a sexual act on a person later identified as the 16-year-old victim.

The reporting officer wrote that the teen first told the officer that he was 18 but fumbled over his date of birth. The report then continues saying that the teen told the officer Hartmann was a teacher.

The teen also told the officer the pair had sex earlier that week and that Hartmann previously sent him inappropriate text messages.

If convicted, she faces up to five years behind bars and a $10,000 fine.

2 NEWS obtained a copy off her 87-page personnel file which indicates she has been with the Huber Heights City Schools district since 2009. According to the file, Hartmann was placed on administrative leave on Nov. 23 and was informed she was not allowed on school property and can not have any form of contact with students without prior consent from the district.

A March 29, 2012 evaluation recommended Hartmann for continued employment, noting that she had "Distinguished" instruction.
