UD's Kavanaugh will not face criminal charges

DAYTON, Ohio (WDTN) - We heard officially Friday that University of Dayton basketball player Matt Kavanaugh will not face criminal charges.

But, his punishment at school stands.

The University of Dayton suspended Kavanaugh from the team for violating the "UD standards of behavior and code of conduct".

They did not say exactly what Kavanaugh did.

Montgomery County prosecutors responded Friday and said the action did not merit criminal charges.

"I want to applaud the administration of the University of Dayton for taking these allegations seriously and taking appropriate action," said Prosecutor Mat Heck, Jr. "Too many other universities and institutions seem to hide accusations of misconduct by faculty or students. The university and the university police department were most cooperative with my office wile we were reviewing this matter.

Heck went on to say in a statement, "Student disciplinary action is separate and distinct from any potential criminal charges. Improper behavior by students is not always criminal in nature and in this instance, the evidence did not support a criminal charge.
