Murder suspect out despite mom's plea

DAYTON, Ohio (WDTN) - 2 NEWS Investigates looked through various public records to find out that 39-year old Dameon Wesley was released from prison in Ohio in September 2012, despite the pleas of not only the mother of his 1994 victim, but also against the recommendation of the Montgomery County Prosecutor's Office.

Police say Wesley killed again Sunday ; this time his alleged victim, a 13-year old girl.  The Montgomery County Prosecutor's Office has now charged him with murder, kidnapping, aggravated burglary and felonious assault.

The Ohio Parole Board three times denied Wesley release stating, "the release of the inmate into society would create undue risk to public safety." 

However, another hearing was held June 19, 2012 and after hearing testimony the board eventually decided to release Wesley from behind bars stating, "The Board finds that inmate Wesley has made an acceptable institutional adjustment, has formulated an appropriate release plan and has participated in programming that suggests that his risk can be safely managed under parole supervision at this time."

Gwendolyn Williams was at that June hearing.  She's the mother of the late Marvin Williams, Jr.   Wesley shot Williams to death January 4, 1994 on West Riverview Avenue in Dayton.  Wesley was sentenced to 15 years to life for the murder.  Ms. Williams told 2 NEWS Investigates she remembers telling the parole board that Wesley should stay in prison at least five more years.

The Montgomery County Prosecutor's Office told 2 NEWS Investigates that it wrote a letter in May of 2012 opposing parole for Wesley.

2 NEWS Investigates also learned that the prosecutor's office was told about an alleged sexual assault that might have involved Wesley last month, but it didn't think there was enough evidence for charges and that case was refused.

The sexual assault case also involved the teenager murdered on Sunday , 13-year-old Briona Rodgers.  Again, that case resulted in no charges.
