Ohio Supreme Court sets convicted killer free after 7-yrs in prison

DAYTON, Ohio (WDTN) - Attorneys for a Columbus woman convicted of murdering a Springfield man say she is out of jail.

2 NEWS was told that Toneisha Gunnell was released from the Dayton Correctional Institution and is waiting for her mother to pick her up.

Gunnell and three other women were fleeing from security guards after shoplifting clothing from the Upper Valley Mall in Springfield when they hit and killed John Deselem.

Gunnell was found guilty in her first trial. In a second trial, a mistrial was declared.

Gunnell was tried for a third time and found guilty on all charges and sentenced to prison.

She appealed that conviction, citing double jeopardy and the Ohio Supreme Court agreed Thursday that Gunnell should not have been retried.

Gunnell spent seven years behind bars.
