Sister wants death penalty for brother

Cody Henderson accused of murder

DAYTON,Ohio (WDTN) - Nineteen-year-old Cody Henderson is accused of stabbing his step-father to death. Henderson's sister said she wants prosecutors to seek the death penalty.

Cody Henderson is locked up in the Montgomery County Jail. He's being held on a $1 million bond.   Henderson is facing charges of aggravated murder, aggravated assault, felonious assault and tampering with evidence in connection with the murder of his stepfather, Charles Zan.

Henderson's sister, 21-year-old Misty Henderson turned her brother into the police.

"That is a terrible thing to say about your own family, but everything just fits." she said.

Misty said her brother broke into their parents home in the 7100 hundred block of Springboro Pike on October 17 and stabbed Zan over 40 times.

Misty said her brother has been violent in the past.

"He's choked a couple of ex-girlfriends.  He's put his hands on me a couple of times," she said.  "It was never that extreme.  He never left marks on skin or anything.  He was always remorseful after, even if he didn't remember what happened."

Henderson said Cody and their stepdad had a rocky relationship since their mother and Zan married seven years ago, but recently they were getting along.

Misty said her brother committed the crime, but cannot figure out why he would do something so heinous.

"I don't have a clue. I ran a bunch of different scenarios through my head how things could've happened but the thing I could never come up with is a motive." she said.

Montgomery County prosecutors said officials haven't decided whether to seek the death penalty for Henderson, but Misty said she has already made up her mind

"I saw my stepdad's body two days ago and I've completely changed my opinion.  I think for what he did, he should get the death penalty," Misty said.  "Family or not, I think that is the only punishment worthy of the damage that he did.  It's for the best. It's what is going to get Chuck justice."

Charles Zan was a military veteran. Recently he served in the Army Reserves and worked as a correctional officer at the Warren County Corrections Institute.

Misty said her brother Cody has a two year old son, and another baby on the way.
