COLUMBUS, Ohio (WDTN) - A new legal victory Wednesday for a Fairborn man whose rape conviction was voided after 20 years in prison.
The Ohio Supreme Court refused to review an appeal of the Roger Dean GIllispie case filed by the Montgomery County Prosecutor.
Prosecutor Mat Heck argued Gillispie should not be out of prison.
He was released last Christmas by an appeals judge who ruled Gillispie did not get a fair trial.
Gillispie was twice convicted of sexual assaults that date back to 1988.
There are still other court cases pending which could leave the ultimate decision about Gillispie's fate in the hands of the US Supreme Court.
