Berry: Not guilty in fatal hit-and-run

SPRINGFIELD, Ohio (WDTN) - A former Clark County prosecutor accused in fatal hit-and run accident has been found not guilty.

James Berry was on trial for fatally striking 37-year-old James Pierce in Springfield Township in May 2010.  Visiting Judge John Kessler made the ruling in a Clark County common Pleas courtroom Feb. 2.

Surveillance video from a nearby business recorded the accident as it happened. It showed Pierce stumbling, then falling onto Springfield-Xenia Road just before he was struck.

Berry maintained that he thought he hit a pothole and that was why he did not stop.

He faced up to five years in prison if convicted.
