Fine paid but owners locked out of land

Family considers suing Clearcreek Township

CLEARCREEK TOWNSHIP, Ohio (WDTN) - The Gray family has been battling Clearcreek Township over the use of its driveway at 2248 Pennyroyal Road. Part of the driveway runs through property not zoned for commercial purposes and the Grays have been using it to access their storage business that is zoned "light industrial."

Now because of a court order there's a fence up on the line where Warren and Montgomery Counties meet and the gate is locked.  The family can only access the Montgomery County property when the zoning administrator for Clearcreek Township unlocks the gate.

Jeff Palmer from the township told 2 NEWS that is due to a court order. The Grays and any remaining customers of the storage facility need to go through him to gain access. He wasn't sure if anyone still had items in storage there.

Palmer did say the Grays have paid the township the fine of $1750.00 due today (Friday) and money to cover the survey of the land.

Palmer told 2 NEWS the Grays still owe the township $7,000.
