DAYTON, Ohio (WDTN) - A Dayton woman's push to get a deposit back on a bathroom remodeling job has worked with 2 NEWS Investigates helping her.
Beatrice Etienne's partner of 29-years paid a $2,000 deposit to Bath Fitter in Dayton and signed a contract in May of 2011.
He died two months later before any work started.
Etienne became the Executrix of the Estate giving her the authority to attempt to get back the full deposit.
After an exchange of letters and questions by 2 NEWS Investigates, the president of Bath Fitter, Jason Haught, decided to send a check for $2,000 to Etienne, fully refunding the deposit and changing the company's policy to address unique situations like this.
"I believe contracts are necessary, just like laws, but I think it takes reputable people to interpret those contracts when a tragic situation like a death occurs." said Jason Haught, Bath Fitter President.
"I feel great. It's been quite an experience and it's really pleasing to know that yesterday afternoon I did receive the check and I think point two that is very important is that they changed their internal policy for anyone who would also be in a situation like this and I think I'm most grateful for that," said Beatrice Etienne.
Jason Haught suggests you ask questions before signing a contract, even ask for a clause that addresses death or other unforeseen tragedies.
